Definitions
“Website”, domain www.colegioenfermeriamalaga.com available to internet users.

“User”, natural or legal person using or browsing the website.

“Content”: pages that comprise the whole www.colegioenfermeriamalaga.com domain, which contains all the information and services that the NURSES ASSOCIATION makes available to internet users. They include messages, texts, photographs, charts, icons, logos, technology, links, textures, drawing, sound and/or image files, recordings, software, interface, graphic design and source codes and, basically, any type of content.

“Web”, technical word that describes the access system to information via Internet. The web is set up through pages created with HTML or similar languages and programming mechanisms such as Java, JavaScript or PHP, among others. These pages designed and published under a domain name are the result of the information that the owner makes available to internet users.

“Hyperlink”, technique by which the user can navigate through different web pages, or the Internet, by simply clicking on a word, icon, button or element containing the link.

“Cookies”, technical medium used to analyse the “traceability” and tracking of website navigation. These small text files are stored on the user’s computer. This method has implications in terms of privacy and, therefore, the NURSES ASSOCIATION shall duly and promptly notify about their use at the time of their implementation on the site.


Terms of use
The mere use of the Website grants the status of ‘user’ (either a natural or legal person), which it necessarily implies the full acceptance of every single clause and general conditions included in the Legal Notice. Should the User not be in conformity with any of the clauses or terms of use of this Legal Notice, he/she shall refrain from using the Website.

This Legal Notice is subject to changes and updates, so the published version by the NURSES ASSOCIATION might vary every time the User accesses the Website. Therefore, the User must read the Legal Notice every time he/she visits the Website.

The NURSES ASSOCIATION website gives access to Users to several contents published through the Internet by the NURSES ASSOCIATION or by authorized third parties.

The User is obliged and commits him/herself to use the Website and Contents in compliance with the current legislation, the Legal Notice or any other communications or instructions brought to his/her knowledge, either by means of the Legal Notice or by any other page within the Website, also with the norms of peaceful coexistence, moral principles and good manners.
To that effect, the User is obliged and agrees NOT to use any of the Contents for any purpose that is unlawful or prohibited by these Legal Notice or the current legislation, or causing damage to the rights and interests of third parties, or that may in any way damage, render useless, overload, impair or prevent the normal use of the Contents, computer equipment, or documents, files or any other content stored on any computer, either hired by the NURSES ASSOCIATION or owned by other Users or any Internet user (hardware and software).

The User is obliged and agrees not to transmit, distribute or make available to third parties any type of content of the Website, including but not limited to: information, texts, data, content, messages, graphics, drawings, sound/image files, photographs, recordings, software, logos, brands, icons, technology, links, graphic design and source codes, or any other material that the Website user may have access to.
Likewise, in accordance with the foregoing, the User shall not:
- Reproduce, copy, distribute, make available or publicly communicate, transform or modify the Contents without a prior written approval from the NURSES ASSOCIATION, which is the holder of the corresponding rights or it is legally permitted.

The User shall refrain from obtaining or even attempting to obtain the Contents by means or procedures other than those that have, where applicable, been made available to this end or are indicated for this purpose on the Website pages where the Contents are located or, in general, those normally used on the Internet for this purpose, provided that they do not entail a risk of damaging or rendering inoperative the Website and/or its Contents.

REGISTRATION IS REQUIRED TO ACCESS CERTAIN SERVICES. It is necessary to register on the Website in order to take part in the forums. To that end, a series of personal data will be requested. Likewise, members must register to access the private area of the Website.

Conduct of Website Users in forums, blogs and Social Networks where the NURSES ASSOCIATION may be present:

The USER assumes the responsibility for the use of the Website. This responsibility extends to any registration that may be required to access or take part in certain services. In such registration, the USER shall be responsible for providing truthful and lawful information. As a consequence of this registration, the USER may be provided with a password for which he/she will be held responsible, undertaking to make a diligent and confidential use of it. The USER agrees to make appropriate use of the content and services (such as chat services, discussion forums or newsgroups) offered by the NURSES ASSOCIATION through its website. The NURSES ASSOCIATION does not guarantee that the users of the services where the NURSES ASSOCIATION may be present use their contents in compliance with the law, morality, and public order. Likewise, the NURSES ASSOCIATION does not guarantee the truthfulness and accuracy, comprehensiveness and/or authenticity of the data provided by the Users.
The NURSES ASSOCIATION shall not be liable, directly, indirectly or subsidiarily, for damages and losses of any nature that might originate from the use of the Services and Contents of the Websites by the Users or that may arise from the lack of truthfulness, accuracy and/or authenticity of the data or information provided by the Users, or the impersonation of a third party by a User in any kind of activity via the services offered by the NURSES ASSOCIATION. By way of example, but not limited to, the NURSES ASSOCIATION shall not be liable directly, indirectly or subsidiarily for:

  1. a) the contents, information, opinions and assertions of any User/third parties/entities communicated or exhibited through the services offered by the NURSES ASSOCIATION.
  2. b) damages caused to third parties originated from the User’s utilization of the services and contents offered by the NURSES ASSOCIATION.
    c) damages caused by the lack of truthfulness, accuracy or incorrectness of the users’ identifying data and of all the information they provide or make accessible to other users.
  3. d) damages and losses resulting from infractions committed by whatsoever user that affect the rights of other users, or third parties, including copyrights, trademarks, patents, confidential information and any other intellectual and industrial property rights, as well as the utilization of the users’ image.

The user commits him/herself not to transmit, introduce, distribute or make available to third parties any type of material and information (data, content, messages, opinions, drawings, sound/image files, photographs, software, etc.) that are contrary to the law, morality, public order or this Legal Notice. By way of example, and in no case limiting or excluding, the User agrees:

o Not to publish any content or propaganda of a racist, xenophobic, pornographic or terrorist nature, or anything that might undermine human rights or human dignity.

o Not to publish or distribute data programs (viruses and malware) that might cause damage to the computer systems of the access providers, their suppliers or third party Users of the Internet network.
o Not to distribute, transmit or make available to third parties any information, element or content that could constitute illegal or unfair advertising. It is expressly prohibited the utilization of users’ emails for sending unsolicited advertising, links to websites, or any other type of communication that directly or indirectly involves the promotion of a third party’s activity.

o Not to send to Users' emails any type of spam, chain letters, pyramid schemes, or communications that might be offensive, undermine the dignity of the advertiser, or that might go against laws and good manners.

o Not to publish false, ambiguous or inaccurate information and content that might mislead the recipients of the information.
o Not to impersonate other users by using their registry keys to access different services and/or contents of the Websites.

o Not to use the distinctive signs, logos or brands of the NURSES ASSOCIATION for the exclusive benefit of the user without the required authorization from the NURSES ASSOCIATION.

o Not to publish, transmit or make available to third parties any type of information, element or content that might undermine the intellectual and industrial property rights, patents, trademarks or copyrights corresponding to the Website owners or any third party.

o Not to distribute, transmit or make available to third parties any type of information, element or content that might go against the secrecy of communications or personal data legislation.

We kindly ask users to inform us by email (oficina@colegioenfermeriamalaga.es) of any false or misleading information, offensive attitudes or behaviours, images of identifiable people that may be inappropriate or offensive to morals and good manners, as well as of any possible errors they might find in the information provided. This way, we will be able to remove the related information or images, block certain users if necessary, and amend any inaccurate information.


Intellectual property
All brands, trade names or distinctive signs that appear on the Website are owned by the NURSES ASSOCIATION or by third parties who have authorized their use. It may not be construed that using or accessing the Website and/or its Contents implies the granting to the User of any right over these brands, trade names and/or distinctive signs. It may not be inferred either that the exploitation rights that exist or may exist over the mentioned Contents can be transferred to the User.

The Website Content is also the intellectual property of the NURSES ASSOCIATION (or of any third party that might have authorized its use). They have the exclusive rights to exploit the Content in any form and, in particular, the rights of reproduction, distribution, public communication and transformation.

The unauthorized use of the information contained in this Website, as well as any infringement of the Intellectual or Industrial Property rights of the NURSES ASSOCIATION or of any third party that might has transferred contents to the Website shall be subject to the legal responsibilities established to that effect.

Those who intend to establish hyperlinks between their sites and the NURSES ASSOCIATION’s Website shall comply with the following conditions:

- No prior authorization is required as long as the Hyperlink exclusively allows access to the homepage, but does not reproduce it in any form. As for other types of Hyperlinks, an unambiguous written authorization from the NURSES ASSOCIATION will be required.

While browsing through the website, personal data may be required to improve the user experience, get in contact with them (upon request only) or receive emails from the NURSES ASSOCIATION, such as newsletters, gazettes, etc.     

Please be advised that your data will be incorporated into files owned by the NURSES ASSOCIATION, which have been duly registered at the Register of Data Processing Activities of the Nursing School. The purpose of these files is to answer queries and communications received both through the website and social networks; also, to manage our own activity and, finally, to communicate with users and members (even by electronic means) in order to keep them updated on the activities carried out by the NURSES ASSOCIATION.

 

The rights of access, rectification, removal and opposition may be exercised by sending a written communication to the Nursing School address indicated at the beginning of the present Legal Notice. A valid identity proof from the data owner needs to be attached to the communication.


Social Networks. The NURSES ASSOCIATION has the following social networks and/or platforms, and Blogs:

This legal notice (or the one that replaces it) is also applicable to other platforms or social networks that might be created in the future by the NURSES ASSOCIATION.

Any social network accounts redirected from www.colegioenfermeriamalaga.com do not represent any official link for the NURSES ASSOCIATION, which will therefore be exempt from any responsibility in regards to contents posted on such social networks, since the NURSES ASSOCIATION does not have any effective control over them. Nevertheless, if the user experienced any incident regarding a link to a social network or blog that has been accessed through www.colegioenfermeriamalaga.com, he/she may send an email to oficina@colegioenfermeriamalaga.es. The NURSES ASSOCIATION website shall provide the corresponding access to each Social Network where it may be present. By becoming a fan or following the Social Networks where the NURSES ASSOCIATION may be present, the user expressly states his/her agreement to the following:

2º) The access by the NURSES ASSOCIATION to all data stored on the Social Networks where the User has been registered; and

3º) that any published event related to the NURSES ASSOCIATION appear on the wall or profile of the Social Networks’ users.

The NURSES ASSOCIATION shall not use the data for purposes other than those expressly stated.

In order to unregister from the social networks where the NURSES ASSOCIATION is present, users only have to click on the hyperlink "Unlike" or "Unfollow".

In the event of exercising the rights of access, rectification, cancellation or opposition, the user needs to send an email to oficina@colegioenfermeriamalaga.es stating his/her will to unsubscribe.

Likewise, in regards to the present data processing, the NURSES ASSOCIATION can only retrieve the user's data as a follower of the Social Network in which he/she has registered, or unsubscribe them.

Any additional amendment must be carried out through the User’s Social Network accounts.

Jurisdiction
As for any questions that might arise in regards to the interpretation, application and compliance with this Legal Notice, as well as for any claims that may arise from its use, all parties involved agree to submit to the Magistrates and Courts of Malaga, expressly waiving their right to any other jurisdiction that may correspond to them.
